Welcome to CalmCall.ai! These Terms and Conditions ("Terms") govern your use of the CalmCall platform, operated by CalmCall SRL, headquartered in Bucharest, Romania. By accessing and using the platform, you accept these Terms in their entirety.
1. Service Description
CalmCall is a digital mental health platform that offers:
- Voice and text AI companion for emotional support
- AI-assisted therapeutic journal
- Emotional detection and mood tracking
- Access to sessions with licensed therapists (depending on plan)
- Personal development coach (Premium plans)
- Educational resources about mental health
2. Medical Disclaimer
IMPORTANT: CalmCall is not an emergency medical service and does not replace professional diagnosis or treatment. The AI companion is not a psychologist, cannot make diagnoses and does not prescribe medications. The platform is designed as a complement to professional therapy, not as a substitute.
If you are in an emergency situation or have thoughts of self-harm, contact emergency services immediately (911 in US, 112 in EU) or a crisis hotline.
3. Eligibility
- You must be at least 16 years old to use CalmCall
- Persons between 16 and 18 years require parental or legal guardian consent
- You must provide correct and current information when registering
- One account can only be used by one person
4. User Account
You are responsible for maintaining the confidentiality of your account credentials. Any activity conducted through your account is your responsibility. Please notify us immediately at contact@calmcall.ai if you suspect unauthorized use.
5. Emergency Situations Protocol
CalmCall includes automated crisis detection mechanisms. When the AI detects risk indicators, it will:
- Immediately display contact information for emergency services
- Recommend contacting a mental health professional
- Provide relevant resources for the identified situation
- Notify the CalmCall moderation team (without sharing conversation content)
Emergency numbers: 911 (US), 112 (EU), or your local emergency services.
6. Subscriptions and Payments
- Prices are displayed in Euro (EUR) and include VAT where applicable
- Subscriptions automatically renew at the end of each billing period
- Payments are processed securely through Stripe
- You can change plans at any time; price difference is calculated proportionally
7. Cancellation and Refund
- You can cancel your subscription at any time from account settings
- Cancellation takes effect at the end of the current billing period
- There are no penalties for cancellation
- Refunds are granted within 14 days of first purchase, per right of withdrawal
- After the 14-day period, no refunds are granted for partial usage periods
- Account data remains available for 30 days after cancellation
8. Data Retention
Your data is kept according to the following periods:
- Active account: data is kept for the entire duration of account existence
- After cancellation: data is kept for 30 days, then automatically deleted
- Deletion request: data is deleted within a maximum of 30 days from request
- Financial data: kept according to legal requirements (minimum 5 years)
- Backups: deleted within a maximum of 90 days from main data deletion
9. Intellectual Property
All intellectual property rights to the CalmCall platform, including but not limited to source code, design, content, trademarks and AI algorithms, belong to CalmCall SRL. Users do not acquire any intellectual property rights through platform use. AI-generated content within conversations is available exclusively to the respective user.
10. Limitation of Liability
CalmCall and CalmCall SRL are not responsible for:
- Decisions made by users based on interaction with the AI companion
- Deterioration of mental health condition in the absence of professional consultation
- Temporary platform unavailability for technical reasons
- Actions or omissions of independent therapists on the platform
11. Applicable Law
These Terms are governed by the laws of the Republic of Cyprus. Any disputes will be resolved by the competent courts in Bucharest, Romania. For users in the European Union, consumer protection legislation from your country of residence also applies.
12. Changes to Terms
We reserve the right to modify these Terms. You will be notified by email and/or by notification on the platform at least 30 days before changes take effect. Continued use of the platform after changes take effect constitutes acceptance of the new Terms.
